Welcome to On Program ("On Program", "we", "us", or "the app"). These Terms of Use ("Terms") are a legal agreement between you and On Program governing your use of the app. By creating an account, tapping "Agree & Continue," or otherwise using the app, you confirm that you have read, understood, and agree to be bound by these Terms and the accompanying Health & Fitness Disclaimer below. If you do not agree, do not use the app.
Important health & safety notice
On Program provides general fitness and exercise information and programming. It is not a medical service and does not provide medical advice. Exercise involves inherent risks. Consult a qualified physician before beginning this or any exercise program.
The workouts, weights, progressions, coaching messages, and other content in On Program are provided for general informational and fitness purposes only. They are not medical advice, diagnosis, or treatment, and are not a substitute for the advice of a physician or other qualified healthcare professional. Never disregard or delay seeking professional medical advice because of something you read or received in the app. If you think you may have a medical emergency, call your doctor or emergency services immediately.
You should speak with your doctor before starting On Program or making changes to your exercise or nutrition habits, particularly if you have (or may have) any injury, illness, heart condition, high blood pressure, are pregnant or postpartum, are recovering from surgery, or take medication that could be affected by exercise. By using the app you represent that you are in good enough health to participate in physical exercise and have no medical condition that would make doing so unsafe.
You understand that physical exercise — including resistance training, cardio, and any activity suggested by the app — carries inherent risks, including but not limited to muscle strains, sprains, tears, fractures, cardiovascular events, aggravation of pre-existing conditions, serious injury, and in rare cases death. You voluntarily choose to participate and knowingly and freely assume all such risks, both known and unknown, arising from your use of the app, even if caused in whole or in part by the content or suggestions of the app.
Fitness results depend on many factors outside our control, including your effort, consistency, genetics, nutrition, sleep, and health. We make no representation or guarantee about any specific outcome, and results will vary from person to person.
To the fullest extent permitted by law, you release and agree to hold harmless On Program and its owner(s), affiliates, and contributors from any and all claims, demands, liabilities, damages, losses, costs, or expenses (including injury, death, or property damage) arising out of or related to your use of the app or your participation in any exercise, whether based in contract, tort, negligence, or otherwise.
To the fullest extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind, and in no event will our total liability to you for all claims exceed the greater of the amount you paid us in the twelve months before the claim or twenty U.S. dollars (US$20). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
You agree to indemnify and hold harmless On Program from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the app, your violation of these Terms, or your violation of any law or the rights of any third party.
You must be at least 13 years old to use On Program. If you are under the age of majority where you live, you may use the app only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.
You are responsible for the activity on your account and for keeping your login secure. You agree not to misuse the app, interfere with its operation, attempt to access data that is not yours, or use it for any unlawful purpose.
Your use of the app is also governed by our Privacy Policy, which explains what information we collect and how it is used.
We may update these Terms from time to time. When we make material changes, we will update the effective date above and may ask you to re-accept the updated Terms in the app. Your continued use after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction, except where applicable law provides otherwise.
